Section 1.  Be it ordained by the Mayor and City Council of Baltimore, That City Code Article 5, Subtitle 1 {“City Comptroller”} is repealed in its entirety.                     

 

Section 2.  Be it further ordained, That the Laws of Baltimore City read as follows:

 

                     Baltimore City Code

 

                     Article 5.  Finance, Property, and Procurement

 

                     Subtitle 1.  Board of Estimates

 

§ 1-1.  Clerk to the Board of Estimates.

 

(a)  In general.

 

The Comptroller or the Comptroller’s designee  shall perform the duties of Clerk to the Board of Estimates.

 

(b) Required reports.

 

(1) The Clerk to the Board of Estimates shall coordinate the submission of any report that is required to be submitted to the Board of Estimates by the Charter or this City Code.

 

(2) The Comptroller shall retain any report described in paragraph (1) for an appropriate period of time.

 

§ 1-2.  Procurement thresholds.

 

(a)  In general.

 

Pursuant to the authority of City Charter Article VI, § 11(b), the following contract and procurement thresholds are established.

 

(b) Formal advertisement.

 

All expenditures of $50,000 or more shall be formally advertised under City Charter Article VI, § 11(c).

 

(c)  Board approval.

 

All expenditures of $25,000 or more shall be subject to Board of Estimates approval under City Charter Article VI, § 11(f).

 

§ 1-3.  Rules and regulations.

 

Subject to Title 4 {“Administrative Procedure Act - Regulations”} of the General Provisions Article, the Board may adopt rules and regulations as necessary or appropriate.

 

Section 2.  And be it further ordained, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.

 

Section 3.  And be it further ordained, That this Ordinance takes effect on the 30th day after the date it is enacted.
