Section 1.  Be it resolved by the Mayor and City Council of Baltimore, That the City Charter is proposed to be amended to read as follows:

 

                     Baltimore City Charter

 

                     Article 1.  General Provisions

 

§ 17.  Sporting Tournament Scholarship Fund.

 

(a)                     Fund established; Scope.

 

There is a continuing, nonlapsing Sporting Tournament Scholarship Fund, to be used exclusively for purposes of:

 

(1)                     providing educational scholarships to Baltimore City youth and young adults attending a postsecondary institution, to be use d for tuition and fees;

(2)                     administering the Fund;

 

 

(3) publicizing the availability of scholarships through the Fund; and

 

(4) hiring and retaining appropriate staff to administer the Fund.

 

(b)                     Annual appropriation.

 

The Fund shall consist of a mandatory annual appropriation in the Ordinance of Estimates equal to at least 3% of the tax revenue received from sporting tournaments  held in Baltimore City, including hotel tax revenue, in the previous fiscal year.

 

(c)                     Additional revenue sources.

 

 In addition to the annual appropriation required by subsection (b) of this section, the Fund may consist of:

 

(1) grants or donations made to the Fund; and

 

(2)                     proceeds from fines, fees, surcharges, or other revenues dedicated to the Fund by Ordinance.

 

(d)                     Continuing nature of Fund.

 

Notwithstanding any other provision of this Charter, unspent portions of the Fund established under this section:

 

(1)                     remain in the Fund, to be used exclusively for their ordained purposes;

 

(2)                     do not revert to the general revenues of the City; and

 

(3)                     their appropriations do not lapse.

 

(e)                     Implementation.

 

By Ordinance, the Mayor and City Council may provide for the oversight, governance, and administration of the Fund described in this section.                     

 

Section 2.  And be it further resolved, That this proposed amendment to the City Charter be submitted to the legal and qualified voters of Baltimore City, for adoption or rejection, in accordance with Article XI-A, § 5 of the Maryland Constitution, in the form specified by the City Solicitor.
