For the purpose of establishing a date certain when the Board of Estimates shall deliver the Ordinance of Estimates to the City Council; making conforming changes; and submitting this amendment to the qualified voters of the City for adoption or rejection.

Section 1. Be it resolved by the Mayor and City Council of Baltimore, That the City Charter is proposed to be amended to read as follows:

Article VI. Board of Estimates
§ 3. Fiscal year; Budget schedule.
(c) Submission to Council.
[The Board of Estimates shall submit to the City Council the proposed Ordinance of Estimates for the next fiscal year at least forty-five days before the beginning of that fiscal year.]
(1) In general.
Not later than May 1 of each calendar year:
(i) the Board of Estimates shall submit to the City Council the proposed Ordinance of Estimates;
(ii) the Director of Finance shall furnish the City Council with the recommended operating budget; and
(iii) the Planning Commission shall furnish the City Council with the
recommended capital budget and long-range capital improvement
program.
(2) Required submission materials.
Those submissions required by the Director of Finance and the Planning Commission in paragraph (1) of this subsection shall include:
(i) revenue and expenditure details;
(ii) agency and service budget details;
(iii) operating budget highlights;
(iv) capital budget highlights;
(v) budgeted dollars by agency, service, and object; and
(vi) service information.
(d) Adoption by Council.
[The City Council shall have at least forty days after receipt of the Board’s proposed Ordinance of Estimates to enact an Ordinance of Estimates.] The City Council shall adopt an Ordinance of Estimates at least five days prior to the beginning of the fiscal year to which it is applicable [if the Board of Estimates submits its proposed Ordinance of Estimates within the period prescribed by Section 3(c)].
Section 2. And be it further resolved, That this proposed amendment to the City Charter be submitted to the legal and qualified voters of Baltimore City, for adoption or rejection, in accordance with Article XI-A, § 5 of the Maryland Constitution, in the form specified by the City Solicitor.
