Section 1. Be it ordained by the Mayor and City Council of Baltimore, That the Laws of Baltimore City read as follows:

Article 1. Mayor, City Council, and Municipal Agencies

Subtitle 40. Environmental Control Board

§ 40-2. Board established.

(a) In general.

The Environmental Control Board of Baltimore City is established as an independent agency of City Government.

(b) Composition.

(1) The Board comprises [13] 15 members.

(2) [6] 7 are the following ex officio members, or their respective designees:


(i) the Commissioner of Health;

(ii) the Commissioner of Housing and Community Development;

(iii) the Police Commissioner;

(iv) the Fire Chief;

(v) the Director of Public Works; [and]

(vi) the Director of Transportation; and

(vii) a member of the City Council, to be appointed by the President of the City Council .

(3) [7] 8 members are appointed by the Mayor in accordance with Article IV, § 6 of the City Charter.

(c) Qualifications of appointed members.

Of the members appointed under subsection (b)(3) of this section:

(1) 2 members must be appointed from the general public; and
