Section 1.  Be it ordained by the Mayor and City Council of Baltimore, That the Laws of Baltimore City read as follows:

 

                     Article 32.  Zoning

 

                     Title 1.  General Provisions

 

                     Subtitle 3.  Definitions

 

§ 1-304.  Chimney to Day-care center: Child”.

 

(w) Crude oil terminal.

 

(1)  “Crude oil” defined.

 

(i)                     In general.

 

“Crude oil” means any naturally occurring liquid petroleum that is:

 

(A) extracted from geological formations beneath the earth’s surface; and

 

(B) [which] requires further refinement before consumer use.

 

(ii)                     Exclusions.

 

“Crude oil” does not include finished products derived from petroleum, including [but not limited to] asphalt.

 

Comment: Tabulates subparagraph (i) for clarity; and, in subparagraph (ii), deletes “but not limited to” given the definition in § 1-206 of “including” to the same effect.

 

§ 1-313.  Roofline to Substantial construction”. 

 

(k-1)  Single-family dwelling.

Comment: Adds a cross-reference to aid those unfamiliar with the alphabetical listing of the various “dwelling” types in § 1-305.

 

 

                     Title 5.  Applications and Authorizations

 

                     Subtitle 3.  Variances

 

§ 5-301.  Purpose.

 

(b)  Application.

 

The variance procedure applies only to changes in bulk and yard regulations and to changes in signage, parking, and loading requirements.  It does not apply to changes in the uses, the maximum quantity of signs, the location requirements of signs, [and] or the types of signs allowed within a zoning district.

 

Comment: In the second sentence, adds “the” twice for clarity and consistency with the preceding listed items; and corrects the conjunction for clarity.

 

 

                     Title 17.  Signs

 

                     Subtitle 1.  Purpose of Title; Definitions

 

§ 17-102.  Definitions.

 

(j)  Freestanding sign.

 

(3)  Types.

 

(i)                     A freestanding sign may be either a freestanding monument sign, a freestanding pole sign, or a freestanding pylon sign.

 

(ii)                     For purposes of this definition:

 

(A)  “[freestanding] Freestanding monument sign” means any freestanding sign that is placed directly on the ground or supported by [the ground,] a decorative base, including [any] a post, pole, or other structure, [which must be] that is an integral part of the sign design[; and].

 

(B) “[freestanding] Freestanding pole sign” means any freestanding sign that is erected and maintained on 1 or more freestanding poles, uprights, or braces directly inserted into the ground and is not attached to any other structure.

 

(C)  “[freestanding] Freestanding pylon sign” means any freestanding sign that is [placed directly on or] supported [by ground] by a support structure that is a solid-appearing base constructed of a permanent material, such as concrete block, brick, or metal.  The ground support does not include any post, pole, or other structure.

 

Comment: Clarifies incomprehensible language of (and apparent inconsistencies between) subparagraphs (ii)(A) and (C).  

 

 

                     Title 18.  Nonconformities

 

                     Subtitle 3.  Nonconforming Uses

 

§ 18-304.  Restoration of damaged structures.

 

(a)  In general.

 

If a structure containing a nonconforming use is damaged or destroyed or if a nonconforming sign is damaged or destroyed, the structure or sign may be repaired or reconstructed and the nonconforming use or sign re-established as long as no new nonconformities are created and the existing degree of any nonconformity is not increased.

 

Comment: Improved sentence clarity.

Comment to Following Table Corrections: All of the proposed corrections to the following Table are flagged by yellow highlighting. 

 

For the most part, the amendments insert clarifying language inadvertently omitted - e.g., throughout the “Maximum Area Per Sign” column, the several entries of “2 sq.ft. per width of canopy or frame” is corrected to refer to “2 sq.ft. per linear foot of ... width”; or in the “Maximum Quantity” column, the entry “1 per lot; 2 per corner lot” is corrected to “1 per interior lot, 2 per corner lot”. 

 

Conversely, some overwrought entries are simplified  - e.g., in the “Maximum Quantity” column for Wall Signs (Above Ground Floor) in the C-5-DC District, the entry of “2 per interior lot, 2 per corner” is simplified to refer to “2 per lot”.

 

And, in a few instances, outright erroneous entries have been corrected to conform to their counterparts elsewhere - see, e.g., in the TOD-1 District, the corrected entry for Billboard and the corrected entry for Provisional Fence Sign and compare these to their counterpart entries throughout the rest of the Table.
