For the purpose of requiring the Health Commissioner, during the pendency of a declared health emergency, to publish certain aggregate data on the City’s website regarding Baltimore City residents diagnosed with an infectious disease and those City residents who have died from that infectious disease; requiring that the published data be disaggregated by race, gender, age, and zip code; and providing for a special effective date.

Section 1. Be it ordained by the Mayor and City Council of Baltimore, That the Laws of Baltimore City read as follows:

Title 4. Disease Control
Subtitle 1. General Provisions
§ 4-104. Health emergency - Data reporting.
(a) Scope.
The requirements of this section only apply if:
(1) either:
(i) the Governor has issued a proclamation declaring a catastrophic health emergency under Title 14, Subtitle 3A of the State Public Safety Article {“Governor’s Health Emergency Powers”}; or
(ii) the Mayor has issued an order or proclamation declaring a state of emergency under § 14-111 {“Local state of emergency”} of the State Public Safety Article;
(2) the order or proclamation described in paragraph (1) of this subsection is in effect; and
(3) the order or proclamation described in paragraph (1) of this subsection was issued as the result of an infectious disease outbreak.
(b) Reporting.
(1) In general.
Utilizing available data, the Commissioner shall publish daily reports on the City’s website indicating:
(i) the aggregate number of Baltimore City residents diagnosed with the infectious disease underlying the emergency described in subsection (a) of this section; and
(ii) the aggregate number of Baltimore City residents who have died as a result of the infectious disease underlying the emergency described in subsection (a) of this section.
(2) Disaggregation of data.
The data published under this subsection shall be disaggregated by race, gender, age, and zip code.
(c) Construction of section.
(1) The report published under this section shall be prepared in accordance with applicable State and Federal laws and regulations regarding the dissemination of health data.
(2) Nothing in this section may be construed to require the Commissioner to collect or obtain data that is not already available to the Commissioner.
Section 2. And be it further ordained, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.
Section 3. And be it further ordained, That this Ordinance takes effect on the date it is enacted.
