AN ORDINANCE concerning

Title

Sporting Events - Offenses Involving

 

FOR the purpose of modifying the penalties for certain offenses involving sporting events; and correcting, clarifying, and conforming related language.

   SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Laws of Baltimore City read as follows:

 

                     Baltimore City Code

 

                     Article 19.  Police Ordinances

 

                     Subtitle 48.  Sporting Events

 

§ 481.  Throwing missiles.

 

   (a)  “Missile” defined.

 

[As used in] IN this section, [the word] “missile” means any object [or thing] capable of being thrown or used as a projectile, but does not include empty paper wrappers.

 

   (b)  Exclusions.

 

This section [shall] DOES not apply to a member of a team or AN official participating as a principal in a sporting event while engaged in the course of conduct required by [such] THAT sporting event.

 

 

   (c)  Prohibited conduct.

 

It [shall be] IS unlawful for any person [or persons] to toss, throw, fling, or project, or to cause the tossing, throwing, flinging, or projecting of any missile:

 

(1)                     [upon] ON or in the direction of any member of a team or official participating as a principal in a sporting event; or

 

(2)                     [upon] ON any playing field or arena during the course of [such] A SPORTING event.

 

   (d)  Penalties.

 

Any person [violating the provisions] WHO VIOLATES A PROVISION of this section is guilty of a misdemeanor and, [upon] ON conviction [thereof], [shall be punished by] IS SUBJECT TO a fine of not more than [$250] $1,000 or [by] TO imprisonment for not more than [3] 12 months[,] or TO both [such] fine and imprisonment FOR EACH OFFENSE.

 

§ 483.  Preakness Stakes tickets.

 

   (a)  Prohibited conduct.

 

[A person must not] IT IS UNLAWFUL FOR ANY PERSON TO offer for sale or resale or TO possess for sale or resale any Preakness Stakes ticket that:

 

(1)                     is forged or counterfeit; or

 

(2)                     is in any way printed or issued without the consent of the Maryland Jockey Club of Baltimore City, Inc.

 

   (b)  Penalties.

 

(1)                     Any person who violates A PROVISION OF this section is guilty of a misdemeanor and, on conviction, is subject to a fine of not more than $1,000 for each offense.

 

(2)                     [A person may be charged with a separate offense for each] EACH ticket that [the person offers] IS OFFERED or [possesses] POSSESSED in violation of this section IS A SEPARATE OFFENSE.

 

§ 484.  Flying over stadium.

 

(a)  Prohibited conduct.

 

[A person shall not] IT IS UNLAWFUL FOR ANY PERSON operate an aircraft over or around the outer limits of [Memorial] M&T BANK Stadium or Oriole Park at Camden Yards for any advertising or commercial purposes.

 

   (b)  Penalties.

 

 

Any [violation] PERSON WHO VIOLATES A PROVISION of this section IS GUILTY OF A MISDEMEANOR AND, ON CONVICTION, [shall be punishable by] IS SUBJECT TO a fine of not [less] MORE than $1,000[, to be imposed upon any person who shall be found guilty of a violation of this section, said fine to be collected in the same manner as any other fine for the violation of other ordinances].

 

   SECTION 2.  AND BE IT FURTHER ORDAINED, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.

 

   SECTION 3.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the 30th day after the date it is enacted.
