AN ORDINANCE concerning

Title

Zoning - Pawnshops, Second-Hand Stores, and Antique Shops

 

FOR the purpose of conforming the zoning classifications of second-hand stores and antique shops to that of pawnshops; allowing second-hand stores and antique shops in the B-2 and B-3 districts only as conditional uses requiring approval by ordinance; defining and redefining certain terms; and generally relating to the zoning use classification of pawnshops, second-hand stores, and antique shops.

SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Laws of Baltimore City read as follows:

                     Article - Zoning

 

§ 1-170.  Pawnshop.

 

"Pawnshop" means a place of business of a person who engages in:

 

(1)                     lending money on the deposit or pledge of personal property or other valuable thing, other than securities or printed evidences of indebtedness; or

 

(2)                     purchasing personal property or other valuable things [on condition of selling] SUBJECT TO THE SELLER'S OPTION TO BUY them back at a stipulated price.

 

§ 1-186.1.  SECOND-HAND STORE.

 

"SECOND-HAND STORE" MEANS A PLACE OF BUSINESS OF A PERSON WHO ENGAGES IN THE BUSINESS OF BUYING FOR RESALE, TRADE, OR TRANSFER USED OR PREVIOUSLY OWNED PROPERTY OR MERCHANDISE, INCLUDING CARVINGS, CLOTHES, CERAMICS, FURNITURE, GLASS, HOUSEHOLD ITEMS, JEWELRY, PAINTINGS, RUGS, SCULPTURES, SILVERWARE, AND OTHER MOVEABLE PERSONAL PROPERTY, BUT EXCLUDING MOTOR VEHICLES, RECORDS, TAPES, COMPACT DISCS, AND BOOKS.

 

§ 6-306.  Permitted uses.

 

In a B-2 District, permitted uses are as follows:

 

[(2)  Antique shops.]

 

[(74)  Second-hand stores and rummage shops.]

 

§ 6-309.  Conditional uses - Ordinance required.

 

In a B-2 District, conditional uses that require approval by ordinance are as follows:

 

(1A)  ANTIQUE SHOPS.

 

(10)  Pawnshops.

 

(12A)  SECOND-HAND STORES.

 

§ 6-406.  Permitted uses.

 

In a B-3 District, permitted uses are as follows:

 

(1)                     As in a B-2 District, except that business establishments are not limited to primarily retail or service establishments.

 

§ 6-409.  Conditional uses - Ordinance required.

 

In a B-3 District, conditional uses that require approval by ordinance are as follows:

 

(1)                     As in a B-2 District (unless it is a permitted use under § 6-406).

 

§ 6-506.  Permitted uses.

 

In a B-4 District, permitted uses are as follows:

 

(1)                     As in a B-2 District, except that business establishments are not limited to primarily retail or service establishments.

 

(1A)  ANTIQUE SHOPS.

 

(15)  Pawnshops.

 

(23A)  SECOND-HAND STORES.

 

§ 6-606.  Permitted uses.

 

In a B-5 District, permitted uses are as follows:

 

(1)                     As in a B-3 or B-4 District.

 

SECTION 2.  AND BE IT FURTHER ORDAINED, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.

 

SECTION 3.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the 30th day after the date it is enacted.
