A RESOLUTION OF THE MAYOR AND CITY COUNCIL concerning

Title

Charter Amendment - Ordinance of Estimates - Council Special Services Fund

 

FOR the purpose of authorizing an annual appropriation to a special fund for the exclusive use of the City Council, for certain purposes and subject to certain conditions; and submitting this amendment to the qualified voters of the City for adoption or rejection.

SECTION 1.  BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the City Charter is proposed to be amended to read as follows:

 

                     Baltimore City Charter

 

                     Article VI.  Board of Estimates

 

§ 5A.  BOARD OF ESTIMATES - COUNCIL SPECIAL SERVICES FUND.

 

(A)                     THE BOARD OF ESTIMATES MAY INCLUDE ANNUALLY IN THE PROPOSED ORDINANCE OF ESTIMATES A GENERAL FUND APPROPRIATION TO BE MAINTAINED IN A SPECIAL SERVICES FUND FOR THE EXCLUSIVE USE BY THE CITY COUNCIL DURING THE NEXT FISCAL YEAR.

 

(B)                     THE AMOUNT APPROPRIATED ANNUALLY FOR THIS SPECIAL SERVICES FUND SHALL BE IN ADDITION TO AND MAY NOT SUPPLANT, BE DEDUCTED FROM, OR SERVE AS A BASIS FOR REDUCING ANY PART OF THE OPERATING BUDGET OF THE CITY COUNCIL.

 

 

(C)                     MONEY APPROPRIATED TO THE FUND MAY BE EXPENDED ONLY:

 

(1)                     PURSUANT TO A RESOLUTION OF THE CITY COUNCIL PASSED BY A VOTE OF THREE-FIFTHS OF THE MEMBERS; AND

 

(2)                     FOR ONE OR MORE OF THE FOLLOWING PURPOSES:

 

(I)                     TO EMPLOY THE SERVICES OF ACCOUNTANTS, ACTUARIES, APPRAISERS, DEMOGRAPHERS, ENGINEERS, LAWYERS, AND OTHER SPECIALISTS AND EXPERTS, AS APPROPRIATE FROM TIME TO TIME, TO COUNSEL AND ADVISE THE CITY COUNCIL; AND

 

(II)                     ANY OTHER PURPOSE SPECIFICALLY AUTHORIZED BY THE BOARD OF ESTIMATES.

 

(D)                     LEGAL COUNSEL MAY BE EMPLOYED UNDER THIS SECTION WITHOUT REGARD TO THE REQUIREMENTS OF ARTICLE VII, §24(C) OF THIS CHARTER.

 

SECTION 2.  AND BE IT FURTHER RESOLVED, That this proposed amendment to the City Charter be submitted to the legal and qualified voters of Baltimore City, for adoption or rejection, in accordance with Article XI-A, § 5 of the Maryland Constitution, in the form specified by the City Solicitor.
