A RESOLUTION ENTITLED
A RESOLUTION OF THE MAYOR AND CITY COUNCIL concerning
Title
The Comprehensive Water and Wastewater Plan for Baltimore City
FOR the purpose of adopting a Comprehensive Water and Wastewater Plan for Baltimore City; and providing for a special effective date.
Body
Recitals
WHEREAS, The State of Maryland requires certain counties and the City of Baltimore to review once every 3 years a comprehensive water and wastewater plan and to adopt amendments or revisions thereof if such revisions or amendments are deemed necessary by the governing body of the county or the Maryland Department of the Environment; and
WHEREAS, Acting on behalf of the City of Baltimore, the Department of Public Works has prepared a plan as aforementioned; and
WHEREAS, The City's Capital Improvement Program shall automatically become part of the Comprehensive Water and Wastewater Plan upon approval of the annual Ordinance of Estimates; and
WHEREAS, As minor technical information is received that revises, but does not materially alter the Comprehensive Water and Wastewater Plan after it has been adopted, it may be added to the plan as appropriate replacement pages; and
WHEREAS, The Public Hearing as required by the State has been held.
SECTION 1. BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Comprehensive Water and Wastewater Plan for Baltimore City, dated 2006, is adopted.
SECTION 2. AND BE IT FURTHER RESOLVED, That in the event it is judicially determined that any word, phrase, clause, sentence, paragraph, section, or part in or of this plan, or the application thereof to any person or circumstance, is invalid, the remaining revisions and the application of such provisions to other persons or circumstances shall not be affected thereby. The Mayor and City Council hereby declaring that they would have ordained the remaining provisions of this plan without the word, phrase, clause, sentence, paragraph, section, or part, or the application thereof, so held invalid.
SECTION 3. AND BE IT FURTHER RESOLVED, That this Resolution takes effect on the date it is enacted.
