AN ORDINANCE concerning
Title
Release of Right of Way - a 10-Foot Right-of-Way Granted to the Mayor and City Council of Baltimore, Through the Property of Midtown Baltimore LLC
FOR the purpose of authorizing the release and surrender by the Mayor and City Council
of Baltimore of all of its interests in and to a 10-foot wide right-of-way granted to the City of Baltimore through the property of Midtown Baltimore LLC, the location and course of the 10-foot wide right-of-way to be released being shown on a plat thereof numbered RW 20-35538 prepared by the Survey Control Section; and providing for a special effective date.

Recitals
WHEREAS, by Agreement dated September 29, 1975, and recorded among the Land Records of Baltimore City in Liber R.H.B. No. 3295, Folio 243, Bethlehem Steel Corporation granted to the Mayor and City Council of Baltimore the right-of-way shown on Plat RW 20-35538, dated March 24, 1975, which plat is recorded with the Agreement; and
WHEREAS, the right-of-way hereinafter described is no longer needed for public use, the public utility that had previously been there having been abandoned and/or relocated to another right-of-way that was granted to the Mayor and City Council of Baltimore.
SECTION 1. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Comptroller of Baltimore City be and is hereby authorized on behalf of the Mayor and City Council of Baltimore to execute and deliver to the owner or owners of the land within the right-of-way hereinafter described, a release and surrender of all of the interest of the City of Baltimore in the right-of-way described as follows:
Beginning for a 10-foot wide right-of-way to be extinguished at a point on the east side of Key Highway, 106 feet wide, said point of beginning also being the beginning of a right-of-way for Municipal Utilities and Services as shown on Plat RW 20-35538, dated March 24, 1975, and attached to an agreement by and between Bethlehem Steel Corporation and the Mayor and City Council of Baltimore dated September 29, 1975, and recorded among the Land Records of Baltimore City in Liber R.H.B. No. 3295, Folio 243, said point of beginning being distant 47.34 feet southerly, measured along the east side of Key Highway from the south side of the former bed of Montgomery Street, 82.5 feet wide, and running thence binding on the north and northwest outline of said right-of-way, the 2 following courses and distances; namely, North 87º 08' 05" East 51.59 feet and South 44º 02' 40" East 73.15 feet to intersect the existing steel bulkhead line of the Inner Harbor Basin North West, there situate; thence binding on said steel bulkhead line of the Inner Harbor Basin North West, South 01º 34' 25" East 14.81 feet; thence binding on the southeast and south outline of said right-of-way, the 3 following courses and distances; namely, North 44º 02' 40" West 74.53 feet, North 68º 27' 15" West 9.11 feet, and South 87º 08' 05" West 42.18 feet to intersect the east side of said Key Highway, and thence binding on the east side of said Key Highway, North 02º 07' 20" West 10.00 feet to the place of beginning.
Containing 1,266.71 square feet of land, more or less.
All courses and distances in the above description are referred to the true meridian as adopted by the Baltimore Survey Control System.
The use of the right-of-way described hereinabove is no longer needed for public purposes.
SECTION 2. AND BE IT FURTHER ORDAINED, That no deed may pass under this Ordinance unless the deed has been approved by the City Solicitor.
SECTION 3. AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the date it is enacted.
