AN ORDINANCE concerning

Title

Sale of Property - Parcels of Land Lying Within the Loch Raven Watershed

 

FOR the purpose of authorizing the Mayor and City Council of Baltimore to sell, at either public or private sale, all its interest in certain parcels of land being a part of Loch Raven Watershed, Baltimore County, as shown on Plat 116-A-5G filed in the Office of the Department of Public Works, and no longer needed for public use; and providing for a special effective date.

SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That, in accordance with Article V, § 5(b) of the City Charter, the City Comptroller may sell, at either public or private sale, all the interest of the Mayor and City Council of Baltimore in certain parcels of land situate in Baltimore County, and more particularly described as follows:

 

Beginning for Fee Parcel No. 1 at the point formed by the intersection of the south side of Paper Mill Road , as now laid out, and the south side of the western approach road to the old Paper Mill Road Bridge, and running thence binding on the south side of said Paper Mill Road, Easterly by an arc curving to the left with a radius of 529.29 feet the distance of 119.9 feet, more or less, to intersect the north side of the western approach road to said Bridge; thence binding on the north, northwest and northeast sides of the western approach road to said bridge, as now surveyed, the six following courses and distances: namely, South 88º 56' 02" East 3.4 feet, more or less, by a tangent arc curving to the left with a radius of 242.00 feet the distance of 141.18 feet which arc is subtended by a chord bearing North 74º 21' 12.5" East 139.19 feet, South 30º 40' 36" East 3.56 feet, by a non-tangent arc curving to the left with a radius of 250.89 feet the distance of 44.90 feet which arc is subtended by a chord bearing North 54º 29' 16.5" East 44.84 feet, North 40º 55' 42" West 4.97 feet and North 49º 04' 18" East 40.12 feet to intersect the line of the northeasternmost face of the southwest bridge abutment of the old Paper Mill Road Bridge, if projected northwesterly; thence binding in part reversely on said line so projected, in part on the northeasternmost face of said

 

 

bridge abutment, in part on the line of the northeasternmost face of said bridge abutment, if projected southeasterly, and in all, South 40º 55' 42" East 40.00 feet to intersect the southeast side of the western approach road to said bridge, and thence binding on the southeast,  southwest and south sides of the western approach road to said bridge, as now surveyed, the eight following courses and distances; namely, South 49º 04' 18" West 40.10 feet, North 40º 55' 42" West 5.03 feet, by a non-tangent arc curving to the right with a radius of 280.89 feet the distance of 49.38 feet which arc is subtended by a chord bearing South 54º 21' 46.5" West 49.32 feet, North 30º 29' 57" West 2.41 feet, South 54º 37' 13" West 40.06 feet, North 35º 29' 24" West 3.23 feet, by a non-tangent arc curving to the right with a radius of 275.00 feet the distance of 120.11 feet which arc is subtended by a chord bearing South 78º 33' 15.5" West 119.16 feet and North 88º 56' 01" West 118.4 feet, more or less, to the place of beginning.

 

Containing 9,740.63 square feet or 0.2236 acre of land, more or less.

 

Beginning for Fee Parcel No. 2 at the point formed by the intersection of the southeast side of Paper Mill Road, as now laid out, and the southeast side of the eastern approach road to the old Paper Mill Road Bridge, and running thence binding on the southeast and southwest sides of the eastern approach road to said bridge, as now surveyed, the four following courses and distances; namely, South 36º 10' 30" West 136.5 feet, more or less, by a non-tangent arc curving to the right with a radius of 290.00 feet the distance of 51.40 feet which arc is subtended by a chord bearing South 44º 40' 08" West 51.33 feet, South 40º 55' 42" East 5.02 feet and South 49º 04' 18" West 40.14 feet to intersect the line of the southwesternmost face of the northeast bridge abutment of the old Paper Mill Road Bridge, if projected southeasterly; thence binding in part reversely on said line so projected, in part on the southwesternmost face of said bridge abutment, in part on the line of the southwesternmost face of said bridge abutment, if projected northwesterly, and in all, North 40º 55' 42" West 40.00 feet to intersect the northwest side of the eastern approach road to said bridge; thence binding on the northwest and northeast sides of the eastern approach road to said bridge, as now surveyed, the four following courses and distances; namely, North 49º 04' 18" East 40.12 feet, South 40º 55' 42" East 4.98 feet, by a non-tangent arc curving to the left with a radius of 260.00 feet the distance of 46.45 feet which arc is subtended by a chord bearing North 44º 42' 34.5" East 46.39 feet and North 36º 10' 30" East 24.8 feet, more or less, to intersect the southeast side of said Paper Mill Road, and thence binding on the southeast side of said Paper Mill Road, North 51º 25' 23" East 113.9 feet, more or less, to the place of beginning.

 

Containing 5,488.88 square feet or 0.1260 acre of land, more or less.

 

 

Beginning for a Perpetual Aerial Easement for Bridge and Bridge Maintenance at a point northwest of the northwest side of the old Paper Mill Road Bridge having a coordinate value of East 1418714.913 feet and North 668487.779 feet, said point of beginning being on the line of the northeasternmost face of the southwest bridge abutment of the old Paper Mill Road Bridge, if projected northwesterly, and extending from a plane below and paralleling the bottom flange of the lowest beam of the superstructure of said old Paper Mill Road Bridge and ascending to an elevation of unlimited height, and running thence by a straight line through the property now or formerly owned by the Mayor and City Council of Baltimore, North 49º 04' 18" East 349.81 feet to intersect the line of the southwesternmost face of the northeast bridge abutment of said old Paper Mill Road Bridge, if projected northwesterly; thence binding in part reversely on the line of the southwesternmost face of the northeast bridge abutment of the said old Paper Mill Road Bridge, so projected, in part on the southwesternmost face of the northeast bridge abutment of said old Paper Mill Road Bridge, in part on the line of the southwesternmost face of the northeast bridge abutment of said old Paper Mill Road Bridge, if projected southeasterly, and in all, South 40º 55' 42" East 40.00 feet to intersect a line drawn parallel with and distant 40.00 feet southeast of the first line of the easement now being described; thence binding on last said line so drawn, South 49º 04' 18" West 349.81 feet to intersect the line of the northeasternmost face of the southwest bridge abutment of said old Paper Mill Road Bridge, if projected southeasterly, and thence binding in part reversely on the line of the northeasternmost face of the southwest bridge abutment of said old Paper Mill Road Bridge, so projected, in part on the northeasternmost face of the southwest bridge abutment of said old Paper Mill Road Bridge, in part on the line of the northeasternmost face of the southwest bridge abutment of said old Paper Mill Road Bridge, if projected northwesterly, and in all, North 40º 55' 42" West 40.00 feet to the place of beginning.

 

Containing 13,992.40 square feet or 0.3212 acre of land, more or less.

 

All courses and distances in the above descriptions are referred to the true meridian as adopted by the State of Maryland NAD 83/91 Datum.

 

Together with the roadbed in Fee Parcels Nos. 1 and 2 and the old Paper Mill Road Bridge Structure over the Great Gunpowder Fall, situate in the hereinabove described Perpetual Aerial Easement.

 

Being part of the land which by deed recorded June 1, 1922, among the Land Records of Baltimore County in Liber W.P.C. No.554, Folio 549 was conveyed by Lewis M. Keizer to the Mayor and City Council of Baltimore.

 

As delineated on a plat numbered 116-A-5G prepared by the Survey Control Section and filed on October 7, 2004, in the Office of the Department of Public Works.

 

SECTION 2.  AND BE IT FURTHER ORDAINED, That no deed may pass under this Ordinance unless the deed has been approved by the City Solicitor.

 

SECTION 3.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the date it is enacted.
