AN ORDINANCE concerning

Title

Property Maintenance Code - Rain Barrels

 

FOR the purpose of excepting certain rain barrels from the requirement to elevate objects and materials stored outdoors; clarifying, correcting, and conforming certain language; and generally relating to the outdoor storage of objects and materials.

SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Laws of Baltimore City read as follows:

 

                     Baltimore City Revised Code

 

                     Article - Building, Fire, and Related Codes

 

                     Part VII.  International Property Maintenance Code

 

§ 7-102.  City modifications.

 

The additions, deletions, amendments, and other modifications adopted by the City are as follows:

 

                     Chapter 3.  General Requirements

 

Section 304  Exterior Sanitary Maintenance - General

 

304.7  Outdoor storage.  Outdoor storage must be neat and orderly. 

 

 

                                                               304.7.1  ELEVATION REQUIRED - GENERAL.  [All] EXCEPT AS OTHERWISE SPECIFIED IN THIS § 304.7, ALL stored objects and materials must be elevated at least 1 foot off the ground to prevent rat harborage.

 

304.7.2  ELEVATION REQUIRED - EXCEPTIONS.  THE REQUIREMENTS OF § 304.7.1 DO NOT APPLY TO:

 

A.                     RAIN BARRELS STORED ON A HARD AND IMPERVIOUS SURFACE, OR 

 

B.                     [unless] ANY OTHER OBJECTS OR MATERIALS FOR WHICH THE CODE OFFICIAL DETERMINES THAT elevation is [determined] unnecessary [by the commissioner].

 

303.7.3 [304.7.1]  Caveat.  Nothing in this section authorizes any outdoor storage that is otherwise prohibited by law.

 

SECTION 2.  AND BE IT FURTHER ORDAINED, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.

 

SECTION 3.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the 30th day after the date it is enacted.
