Zoning - Health Care Clinics - Substance Abuse Treatment Centers
FOR the purpose of broadening the classification for clinics; deleting the separate classification for substance abuse treatment centers; redefining certain terms; conforming certain language; and generally relating to the zoning of facilities for the examination and treatment of people on an out-patient basis.

SECTION 1. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Laws of Baltimore City read as follows:

Article - Zoning
§ 1-126. Clinic: [medical or dental] HEALTH CARE.
"Clinic: [medical or dental] HEALTH CARE" means a building the principal use of which is for offices [of physicians or dentists] for the examination and treatment of people on an out-patient basis BY HEALTH CARE PROFESSIONALS OR PROGRAMS THAT ARE LICENSED OR CERTIFIED BY THE STATE .
[§ 1-194. Substance abuse treatment center.
"Substance abuse treatment center" means a facility that provides and represents or advertises itself as providing:
(1) nonresidential counseling, treatment, care, medication, or rehabilitation for individuals who show the effects of substance abuse; or
(2) transportation of individuals for the purpose of substance treatment, care, medication, or rehabilitation.]
§ 4-204. Conditional uses - Ordinance required.
In an R-1 District, conditional uses that require approval by ordinance are as follows:
[(6) Substance abuse treatment centers.]
§ 5-203. Conditional uses - Board approval required.
In an O-R District, conditional uses that require Board approval are as follows:
(5) Clinics: [medical and dental] HEALTH CARE.
§ 5-204. Conditional uses - Ordinance required.
In an O-R District, conditional uses that require approval by ordinance are as follows:

§ 6-209. Conditional uses - Ordinance required.
In a B-1 District, conditional uses that require approval by ordinance are as follows:

§ 6-306. Permitted uses.
In a B-2 District, permitted uses are as follows:

§ 7-208. Conditional uses - Ordinance required.
In an M-1 District, conditional uses that require approval by ordinance are as follows, subject to compliance with the performance standards set forth in Title 12 {"Performance Standards"} of this article:

In an M-2 District, permitted uses are as follows:

§ 10-405. Schedule of required spaces.
Off-street parking spaces must be provided as follows:

SECTION 2. AND BE IT FURTHER ORDAINED, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.
SECTION 3. AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the 30th day after the date it is enacted.
