AN ORDINANCE concerning

Title

Sale of Property - Parcels of Land Being a Part of the Loch Raven Watershed

 

FOR the purpose of authorizing the Mayor and City Council of Baltimore to sell, at either public or private sale, all its interest in certain parcels of land being a part of Loch Raven Watershed, Baltimore County, and no longer needed for public use; and providing for a special effective date.

SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That, in accordance with Article V, § 5(b) of the City Charter, the City Comptroller may sell, at either public or private sale, all the interest of the Mayor and City Council of Baltimore in the parcels of land situate in Baltimore County, and more particularly described as follows:

 

Beginning for Fee Parcel No. 1 at the point formed by the intersection of the north side of Paper Mill Road, 30 feet wide, and the west side of the approach road to the new Paper Mill Road Bridge, and running thence by a straight line drawn at right angles to the north side of said Paper Mill Road, North 01º 34' 09" West 15.00 feet to the north right of way line of the new Paper Mill Road Bridge; thence binding on the north and northwest right of way lines of the new Paper Mill Road Bridge the two following courses and distances; namely, North 88º 25' 51" East 9.02 feet and by a tangent arc curving to the left with a radius of 479.29 feet the distance of 287.45 feet which arc is subtended by a chord bearing North 71º 14' 59" East 283.16 feet to intersect the northeast face of the southwest bridge abutment of the new Paper Mill Road Bridge; thence binding on the northeast face of the southwest bridge abutment of said new Paper Mill Road Bridge, South 38º 15' 47" East 60.40 feet to intersect the southeast right of way line of said new Paper Mill Road Bridge; thence binding on the southeast and southwest right of way lines of said new Paper Mill Road Bridge the three following courses and distances; namely, South 51º 44' 13" West 25.50 feet, North 38º 15' 47" West 11.92 feet and by a non-tangent arc curving to the right with a radius of 529.29 feet the distance of 100.36 feet which arc is subtended by a chord bearing South

 

 

62º 02' 45.5" West 100.21 feet to intersect the north side of said Paper Mill Road, and thence binding on the north side of said Paper Mill Road, South 88º 25' 51" West 198.30 feet to the place of beginning.

 

Containing 11,143.06 square feet or 0.2558 acre of land, more or less.

 

Beginning for Fee Parcel No. 2 at the point formed by the intersection of the southwest face of the northeast bridge abutment of the new Paper Mill Road Bridge and the northwest  right of way line of the new Paper Mill Road Bridge, and running thence binding on the northwest  right of way line of said new Paper Mill Road Bridge, North 51º 44' 13" East 24.50 feet to intersect the northeast side of said new Paper Mill Road Bridge; thence binding on the northeast side of  said new Paper Mill Road Bridge, South 38º 15' 47" East 10.00 feet to the northwest side of said new Paper Mill Road Bridge; thence binding on the northwest side of said new Paper Mill Road Bridge, North 51º 44' 13" East 334.00 feet to intersect the northwest side of Paper Mill Road, 30 feet wide; thence binding on the northwest side of said Paper Mill Road, by a tangent arc curving to the left with a radius of 817.88 feet the distance of 284.88 feet which arc is subtended by a chord bearing, South 41º 34' 36" West 283.44 feet to intersect the southeast right of way line for said new Paper Mill Road Bridge; thence binding on the southeast right of way line for said new Paper Mill Road Bridge, South 51º 44' 13" West 79.50 feet to intersect the southwest face of the northeast bridge abutment of said new Paper Mill Road Bridge, and thence binding on the southwest face of the northeast bridge abutment of said Paper Mill Road Bridge, North 38º 15' 47" West 60.00 feet to the place of beginning.

 

Containing 8,853.51 square feet or 0.2033 acre of land, more or less.

 

Beginning for Perpetual Aerial Easement for the new Paper Mill Road Bridge and for Bridge Maintenance at the point formed by the intersection of the northeast face of the southwest bridge abutment of said new Paper Mill Road Bridge and the northwest  right of way line for said new Paper Mill Road Bridge, and extending from a plane below and paralleling the bottom flange of the lowest beam of the superstructure of said new Paper Mill Road Bridge and ascending to an elevation of unlimited height, and running thence binding on the northwest  right of way line of said new Paper Mill Road Bridge, the two following courses and distances; namely, by a tangent arc curving to the left with a radius of 479.29 feet the distance of 19.50 feet which arc is subtended by a chord bearing North 52º 54' 10" East 19.50 feet and North 51º 44' 13" East 466.50 feet to intersect the southwest face of the northeast bridge abutment of said new Paper Mill Road Bridge; thence binding on the southwest face of the northeast bridge abutment of said new Paper Mill Road Bridge, South 38º 15' 47" East 60.00 feet to intersect the southeast right of way line of said new Paper Mill Road Bridge; thence binding on the southeast right of way line of said new Paper Mill Road Bridge, South 51º 44' 13" West 486.00 feet to intersect the northeast face of the southwest bridge abutment of said new Paper Mill Road Bridge, and thence binding on the northeast face of the southwest bridge abutment of said new Paper Mill Road Bridge, North 38º 15' 47" West 60.40 feet to the place of beginning.

 

Containing 29,162.58 square feet or 0.6695 acre of land, more or less.

 

 

 

All courses and distances in the above descriptions are referred to the true meridian as adopted by the Baltimore Survey Control System.

 

Together with the roadbed in Fee Parcels Nos. 1 and 2 and the new Paper Mill Road Bridge Structure over the Great Gunpowder Falls, situate in the hereinabove described Perpetual Aerial Easement.

 

Being part of the land which by deed recorded June 1, 1922, among the Land Records of Baltimore County in Liber W.P.C. No. 554, Folio 549 was conveyed by Lewis M. Keizer to the Mayor and City Council of Baltimore.,

 

SECTION 2.  AND BE IT FURTHER ORDAINED, That no deed may pass under this Ordinance unless the deed has been approved by the City Solicitor.

 

SECTION 3.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the date it is enacted.
