For the purpose of authorizing the release and surrender by the Mayor and City Council of Baltimore of all its interests in an 18-foot-wide right-of-way granted to the City of Baltimore, the location and course of the 18-foot-wide right-of-way to be released being shown on Plat RW 20-36417, in the Office of the Department of Transportation; and providing for a special effective date.

                     Recitals

 

The right-of-way hereinafter described is no longer needed for public use, as the public utility that had previously been located there has been abandoned and/or relocated to another right-of-way that was granted to the Mayor and City Council of Baltimore.

 

Section 1.  Be it ordained by the Mayor and City Council of Baltimore, That the Comptroller of Baltimore City is hereby authorized on behalf of the Mayor and City Council of Baltimore to execute and deliver to the owner or owners of the land, within the right-of-way, a release and surrender of all of the interest of the City of Baltimore in the right-of-way described as follows:

 

Beginning for an 18-foot right-of-way to be released at the point designated “104” as shown on the Final Subdivision Plan entitled “Memorial; Apartments” and recorded among the Land Records of Baltimore City, Maryland as Plat FMC 4159, the point also being on the northwest side of Jordan Street, 18 feet wide, thence binding on the outline of Lot 3A of the plat and binding on the northwest side of Jordan Street, referring all courses of this description to the Baltimore City Survey Control System, South 46° 16’ 33” West for a distance of 18.00 feet,

 

thence running through Lot 3A of the plat North 43° 32’ 27” West for a distance of 129.35 feet, to intersect the North 46° 16’ 33” East 497.77 feet line of the plat 130.00 feet from the beginning thereof, the point also being on the southeast side of McMechen Street 100 feet wide, thence binding on the outline of  Lot 3A and binding on the southeast side of McMechen Street North 46° 16’ 33” East for a distance of 18.00 feet, thence running through Lot 3A of the plat South 43° 32’ 27” East for a distance of 129.35 feet to the place of beginning.

 

Containing 2,328.30 square feet or 0.053 acres, more or less.

 

As delineated on Plat RW 20-36417 as prepared by the Survey Section and filed on September 13, 2017, in the Office of the Department of Transportation.

 

All courses and distances in the above description are referred to the true meridian as adopted by the Baltimore Survey Control System.

 

The use of the right-of-way described hereinabove is no longer needed for public purposes.

 

Section 2.  And be it further ordained, That no deed may pass under this Ordinance unless the deed has been approved by the City Solicitor.

 

Section 3.  And be it further ordained, That this Ordinance takes effect on the date it is enacted.
