Title
Acquisition of Property - A Parcel of Land to be Acquired for the Special Services Unit of the Solid Waste Collection Division at 6201 Pulaski Highway
FOR the purpose of authorizing the Mayor and City Council of Baltimore to acquire, by purchase or condemnation, the fee simple or other interests in certain property located at 6201 Pulaski Highway, and needed for the Special Services Unit of the Solid Waste Collection Division; and providing for a special effective date.

SECTION 1. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That it is necessary to acquire, for a certain parcel of land situate in Baltimore City that is needed to combine three existing facilities and six different solid waste services into one central location to provide both an efficient and cost effective means of operating the functions of the Special Services Unit of the Solid Waste Collection Division, the fee simple or other interests that the Director of Public Works considers needed or sufficient in the land and improvements located at 6201 Pulaski Highway and more particularly described as follows:
Beginning for the same at the point formed by the intersection of the northwest side of Erdman Avenue, 150 feet wide, and the northeast side of Debelius Avenue, 60 feet wide, and running thence binding on the northeast side of said Debelius Avenue, North 24º 20' 24" West 473.00 feet to the southeast side of Pulaski Highway, varying in width; thence binding on the southeast side of said Pulaski Highway the three following courses and distances; namely, North 14º 14' 06" East 27.39 feet, North 45º 47' 09" East 31.84 feet and North 63º 50' 00" East 187.16 feet to the southeast side of Pulaski Highway, 150 feet wide; thence binding on the southeast side of last said Pulaski Highway, North 69º 17' 30" East 215.40 feet to intersect the division line between Lot 1 and Lot 2 as shown on a
plat entitled "Final Subdivision Plan No. 6201 Pulaski Highway SM, LLC" dated May 12, 2005 and recorded among the Plat Records of Baltimore City in Plat Record F.M.C. No. 3851 on August 2, 2005, there situate; thence binding on said division line, South 24º 20' 24" East 526.06 feet to intersect the northwest side of said Erdman Avenue, and thence binding on the northwest side of said Erdman Avenue, South 69º 17' 30" West 450.00 feet to the place of beginning.
Containing 233,144.08 square feet or 5.3523 acres of land, more or less.
Together with all right, title, interest, and estate that the owner of that property has in all streets, alleys, ways, or lanes, public or private, contained within or abutting the property.
SECTION 2. AND BE IT FURTHER ORDAINED, That the Department of Real Estate, or any other person or agency that the Board of Estimates designates, may negotiate and acquire on behalf of the Mayor and City Council of Baltimore the fee simple or other interests in the land and improvements described in this Ordinance as needed or sufficient for the purposes described in this Ordinance. If the Department of Real Estate, or the person or agency otherwise designated by the Board of Estimates, is unable to agree with the owner on the purchase price for the property, it shall promptly notify the City Solicitor, who shall institute the necessary legal proceedings to acquire by condemnation the fee simple or other interests needed or sufficient for the purposes described in this Ordinance.
SECTION 3. AND BE IT FURTHER ORDAINED, That proceedings for the acquisition by condemnation of the property described in this Ordinance and all rights of all parties interested or affected shall be in accordance with Title 12 of the Real Property Article of the Maryland Code.
SECTION 4. AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the date it is enacted.
