Charter Amendment - Elected Officials - Qualifications for Office

SECTION 1.  BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the City Charter is proposed to be amended to read as follows:

 

                     Baltimore City Charter

 

 

                     Article III.  City Council

 

§ 1.  Legislative Department; qualification and salary of members.

 

(b)  Qualifications.

 

(1)                     Members of the City Council, except the President whose qualifications are provided for in Section 3, shall be citizens of the United States, above the age of twenty-one years and registered voters.

 

(2)                     They also shall be residents of the districts the members have been chosen to represent for at least one year next preceding their election, except as provided in Section 7(e), and during their term of office.

 

(3)                     NO PERSON IS QUALIFIED TO SERVE ON THE CITY COUNCIL IF, AT THE TIME OF FILING A CERTIFICATE OF CANDIDACY OR AT THE TIME OF ELECTION, THE PERSON IS IN ARREARS OF ANY COSTS OR PENALTIES ASSESSED AND DUE FOR  VIOLATIONS OF THE LAWS GOVERNING THE PLACEMENT OF CAMPAIGN SIGNS.

 

§ 3.  President.

 

(a)  Election, qualifications, duties, etc.

 

(1)                     At the same time that they elect the members, the voters shall elect from Baltimore City at large, a person to be the President of the City Council, who shall possess the qualifications required for the Mayor of the City.

 

(2)                     It shall be the President's duty to preside over the City Council, vote on all questions and perform such other duties as may be prescribed by law. The salary of the President shall be set in the Ordinance of Estimates.

 

                     Article IV.  Mayor

 

§ 1.  Election, term, etc.

 

(a)  Election and qualifications.

 

(1)                     The voters of Baltimore City shall elect a Mayor on the Tuesday next after the first Monday in November 2007, and on the same day and month in every succeeding fourth year.

 

(2)                     The Mayor shall be a person of known integrity, experience, and sound judgment.  The Mayor also shall be over 25 years of age, a citizen of the United States, and a resident of the City for at least 1 year next preceding the election and during the term of office.

 

(3)                     NO PERSON IS QUALIFIED TO SERVE AS MAYOR IF, AT THE TIME OF FILING A CERTIFICATE OF CANDIDACY OR AT THE TIME OF ELECTION, THE PERSON IS IN ARREARS OF ANY COSTS OR PENALTIES ASSESSED AND DUE FOR  VIOLATIONS OF THE LAWS GOVERNING THE PLACEMENT OF CAMPAIGN SIGNS.

 

 

                     Article V.  Comptroller

 

§ 1.  Election, term, etc.; Deputy Comptroller, staff.

 

(a)  Election and qualifications; term; salary.

 

(2)                     The Comptroller shall possess the same qualifications as prescribed in this Charter for the Mayor.

 

SECTION 2.  AND BE IT FURTHER RESOLVED, That this proposed amendment to the City Charter be submitted to the legal and qualified voters of Baltimore City, for adoption or rejection, in accordance with Article XI-A, § 5 of the Maryland Constitution, in the form specified by the City Solicitor.
