Sale of Property - Former Bed of Toone Street
FOR the purpose of authorizing the Mayor and City Council of Baltimore to sell, at either public or private sale, all its interest in a certain parcel of land known as the former bed of Toone Street, extending from Ponca Street easterly to the Right of Way Line of Interstate Route No. 895 (Baltimore Harbor Tunnel) and no longer needed for public use; and providing for a special effective date.

SECTION 1. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That, in accordance with Article V, ยง 5(b) of the City Charter, the City Comptroller may sell, at either public or private sale, all the interest of the Mayor and City Council of Baltimore in a certain parcel of land known as the former bed of Toone Street, extending from Ponca Street easterly to the Right of Way Line of Interstate Route No. 895 (Baltimore Harbor Tunnel), and more particularly described as follows:
Beginning for Parcel No. 1 at the point formed by the intersection of the south side of the former bed of Toone Street, 70 feet wide, and the east side of Ponca Street, 70 feet wide, and running thence binding on the east side of said Ponca Street, Northerly 70.0 feet to intersect the north side of the former bed of said Toone Street; thence binding on the north side of the former bed of said Toone Street, Easterly 180.4 feet, more or less, to intersect the western Right of Way Line of Through Highway of Interstate Route No. 895 (Baltimore Harbor Tunnel), there situate; thence binding on the western Right of Way Line of Through Highway of said Interstate Route No. 895, Southerly 70.0 feet to intersect the south side of the former bed of said Toone Street, and thence binding on the south side of the former bed of said Toone Street, Westerly 180.4 feet, more or less, to the place of beginning.
Subject to a full width Perpetual Easement for all Municipal Utilities and Services, not to be abandoned, over the entire hereinabove described parcel of land.
This property being no longer needed for public use.
SECTION 2. AND BE IT FURTHER ORDAINED, That no deed may pass under this Ordinance unless the deed has been approved by the City Solicitor.
SECTION 3. AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the date it is enacted.
