  SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Laws of Baltimore City read as follows:

      Title 7.  Waste Control
 
      Subtitle 2.  Solid Waste Collection
 
§ 7205.  In general.
 
No person may operate as a hauler in the City without a license to do so from the Commissioner of Health.
 
 
 
 
 
     
§ 7208.  Issuance of license.
 
The Commissioner must issue a license to the applicant if the applicant:
 
(1)      has complied with all applicable laws, rules, and regulations; and
 
(2)      pays the applicable license fee.
 
§ 7209  Term and renewal of license.
 
  (a)  Term of license.
 
(1)      AN APPLICANT MAY, AT THE APPLICANT'S OPTION, APPLY FOR EITHER AN ANNUAL LICENSE OR A 90-DAY LICENSE.
 
(2)      Unless sooner suspended or revoked[,]:
 
(I)      [a] AN ANNUAL license expires on [December 31 of each year] ON THE 1ST ANNUAL ANNIVERSARY OF ITS ISSUANCE; AND
 
(II)      A 90-DAY LICENSE EXPIRES ON THE 90TH DAY AFTER ITS ISSUANCE.
 
  (b)  Application for renewal.
 
Before a license expires, the licensee periodically may renew the license for an additional 1year OR 90-DAY term, AS THE CASE MAY BE, if the licensee:
 
(1)      otherwise is entitled to a license;
 
(2)      submits a renewal application to the Commissioner, on the form that the Commissioner provides; and
 
(3)      pays the applicable [annual] fee.
 
§ 7210.  License fees.
 
(a)  In general.
 
The fees to be charged under this subtitle are as set by the Commissioner, with the approval of the Board of Estimates.
 
  (b)  [Small haulers] DIFFERENTIALS.
 
The fees so set:
 
(1)      MUST INCLUDE AN PRO RATED DIFFERENTIAL FOR 90-DAY LICENSES; AND      
 
(2)      may include an appropriate differential for small haulers.
 
  SECTION 2.  AND BE IT FURTHER ORDAINED, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.
  
   SECTION 3.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the 30th day after the date it is enacted.
