FOR the purpose of condemning and closing certain streets and alleys bounded by Guilford Avenue, East 21st Street, Barclay Street, and East 20th Street (Ward 12, Section 12, Block 3806), as shown on Plat 91-A-53B in the Office of the Department of General Services; and providing for a special effective date.

  SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Department of General Services shall proceed to condemn and close certain streets and alleys bounded by Guilford Avenue, East 21st Street, Barclay Street, and East 20th Street (Ward 12, Section 12, Block 3806), and more particularly described as follows:
 
Beginning for Parcel Number 5, at a point on the south side of East 20th Street 20 feet wide, said point of beginning being distant Westerly 82.0 feet more or less,  measured along the south side of said East 20th Street, from the west side of Barclay Street 66 feet wide, to the east side of a 10-foot alley, laid out in the rear of the properties known as 2000 through 2008 Barclay Street, thence binding on the east side of said alley, the following courses and distances;
 
1.      Southerly the distance of 70.0 feet, more or less, to intersect the north side of a 3-foot alley, thence binding on the north side of said alley;
 
 
2.      Westerly the distance of 10.0 feet, more or less, to a point formed by the intersection of the south side of Worsley Street varying in width, and the west side of said 10-foot alley, thence binding on the west side of said alley;
 
3.      Northerly the distance of 70.0 feet, more or less, to intersect the south side of said East 20½ Street, thence binding on the south side of said East 20½ Street;
 
4.      Easterly the distance of 10.0 feet, more or less, to the point of beginning.
 
Containing 700 square feet or 0.0161 acres, more or less.
 
Beginning for Parcel Number 6, at a point on the east side of Guilford Avenue 66 feet wide, said point of beginning being distant Southerly 136.50 feet, more or less, measured along the east side of said Guilford Avenue, from the south side of East 21st Street 66 feet wide, thence binding on the east side of said Guilford Avenue, the following courses and distances;
 
1.      Easterly the distance of 360.0 feet, more or less, to intersect the west side of Barclay Street 66 feet wide, thence binding on the west side of said Barclay Street;
 
2.      Southerly the distance of 20.0 feet to intersect the south side of 20½ Street 20 feet wide, thence binding on the south side of said East 20½ Street;
 
3.      Westerly the distance of 360.0 feet, more or less, thence binding on the south side of said East 20½ Street to intersect the east side of said Guilford Avenue, and thence binding on the east side of said Guilford Avenue;
 
4.      Northerly the distance of 20.0 feet, more or less, to the point of beginning.
 
Containing 7,200 square feet or 0.1653 acres, more or less.
 
Beginning for Parcel Number 7, at a point on the south side of East 20½ Street 20 feet wide, said point of beginning being distant Easterly 80.0 feet, more or less, measured along the south side of said East 20½ Street, from the east side of Guilford Avenue 66 feet wide, and the south side of said East 20½ Street, to intersect the west side of a 10-foot alley, the following courses and distances;
 
1.      Easterly the distance of 10.0 feet, more or less, to intersect the east side of said alley, thence binding on the east side of said alley;
 
2.      Southerly the distance of 50.0 feet, more or less, to intersect the north side of Worsley Street varying in width, thence binding on the north side of said Worsley Street;
 
3.      Westerly the distance of 10.0 feet, more or less, to intersect the west side of said alley, and thence binding on the west side of said alley;
 
4.      Northerly, 50.0 feet, more or less, to the point of beginning.
 
Containing 500 square feet or 0.0115 acres, more or less.
 
Beginning for Parcel Number 8, at a point on the south side of Worsley Street varying in width, said point of beginning being distant Easterly 265.66 feet, more or less, measured along the south side of said Worsley Street, from the east side of Guilford Avenue 66 feet wide, said point being the northwest corner of a 3-foot alley, thence binding on the northwest corner of said alley, the following courses and distances;
 
1.      Easterly the distance of 62.66 feet, more or less, to the line of division between the properties known as numbers 338 through 340 East 20th Street, thence binding on the division line of said properties;
 
2.      Southerly the distance of 3.0 feet, more or less, measured along the division line of said properties firstly mentioned, to the south side of said 3-foot alley, laid out in the rear of the properties known as numbers 332 through 338 of said East 20th Street, thence binding on the south side of said alley;
 
3.      Westerly the distance of 62.66 feet, more or less, to intersect the east division line of the property known as number 330 East 20th Street, and thence binding on the east division line of said property;
 
4.      Northerly the distance of 3.0 feet, more or less, to the point of beginning.
 
Containing 188 square feet or 0.0043 acres, more or less.
 
Beginning for Parcel Number 9, at a point on the north side of East 20½ Street 20 feet wide, being distant Westerly 80.0 feet, more or less, measured along the north side of said East 20½ Street from the west side of Barclay Street 66 feet wide, thence binding on the north side of said East 20½ Street, to intersect the east side of a 10-foot alley, thence binding on the east side of said alley the following courses and distances;
 
1.      Westerly the distance of 10.0 feet, more or less, to intersect the west side of said alley, thence binding on the west side of said alley;
 
2.      Northerly the distance of 50.0 feet, more or less, to intersect the south side of another 10-foot alley, thence binding on the south side of said alley;
 
3.      Easterly the distance of 10.0 feet, more or less, to a point formed by the intersection of the south of said alley and the west outline of the properties known as numbers 2016 through 2010 Barclay Street, and thence binding on west outline of said properties;
 
4.      Southerly the distance of 50.0 feet, more or less, to the point of beginning.
 
Containing 500 square feet or 0.0115 acres, more or less.
 
Beginning for Parcel Number 10, at a point on the north side of East 20½ Street 20 feet wide, said point of beginning being distant Easterly 80.0 feet, more or less, measured along the north side of said East 20½ Street, from the east side of  Guilford Avenue 66 feet wide, thence binding on the north side of said East 20½ Street, the following courses and distances;
 
1.      Northerly the distance of 50.0 feet, more or less, to a point formed by the intersection of the eastern outline of the properties known as numbers 2023 through 2029 Guilford Avenue and the south side of another 10-foot alley, thence binding on said alley;
 
2.      Easterly the distance of 10.0 feet, more or less, to the east side of said alley running parallel with said Guilford Avenue, thence binding on the east side of said alley;
                 
3.      Southerly the distance of 50.0 feet, more or less, to intersect the north side of said East 20½ Street, and thence binding on the north side of said East 20½ Street;
 
4.      Westerly the distance of 10.0 feet, more or less, to the point of beginning.
 
Containing 500 square feet or 0.0115 acres, more or less.
 
Beginning for Parcel Number 11, at a point on the east side of Guilford Avenue 66 feet wide, said point of beginning being distant Northerly 80.0 feet, more or less, measured along the east side of said Guilford Avenue, from the north side of East 20th Street 66 feet wide, thence binding on the east side of said Guilford Avenue the following course and distances;
 
1.      Northerly the distance of 10.0 feet, thence binding on the east side of said Guilford Avenue, to intersect the south outline of the property known as number 2003 Guilford Avenue, thence binding on the south outline of said property;
 
2.      Easterly the distance of 80.0 feet, more or less, to a point formed by the intersection of the north side of Worsley Street varying in width and the east outline of the properties known as numbers 2003 through 2009 Guilford Avenue, thence binding on the east outline of said properties;
 
3.      Northerly the distance of 10.0 feet, to a point formed by the intersection of the north side of Worsley Street varying in width, and the west side of a 10-foot alley, laid out in the rear of the properties known as numbers 2003 through 2009 Guilford Avenue, thence binding on the west side of said alley;
 
4.      Easterly the distance of 188.0 feet, more or less, to intersect the west side of another 10-foot alley, laid out in the rear of the properties known as numbers 2000 through 2008 Barclay Street, thence binding on the west side of said alley;
 
 
5.      Southerly, the distance of 20.00 feet, to intersect the north side a 3- foot alley, laid out in the rear of the properties known as numbers 332 through 338 East 20th  Street, and thence binding on the north side of said alley;
 
6.      Westerly, the distance of 268.0 feet, more or less, to the point of beginning.
 
Containing 4,500 square feet or 0.1047 acres, more or less.
 
As delineated on Plat 91-A-53B, prepared by the Survey Control Section and filed on December 26, 2013, in the Office of the Department of General Services.
 
  SECTION 2.  AND BE IT FURTHER ORDAINED, That the proceedings for the condemnation and closing of certain streets and alleys bounded by Guilford Avenue, East 21st Street, Barclay Street, and East 20th Street and the rights of all interested parties shall be regulated by and in accordance with all applicable provisions of state and local law and with all applicable rules and regulations adopted by the Director of General Services and filed with the Department of Legislative Reference.
 
  SECTION 3.  AND BE IT FURTHER ORDAINED, That after the closing under this Ordinance, all subsurface structures and appurtenances now owned by the Mayor and City Council of Baltimore continue to be the property of the Mayor and City Council, in fee simple, until their use has been abandoned by the Mayor and City Council. If any person wants to remove, alter, or interfere with them, that person must first obtain permission from the Mayor and City Council and, in the application for this permission, must agree to pay all costs and expenses, of every kind, arising out of the removal, alteration, or interference.
 
  SECTION 4.  AND BE IT FURTHER ORDAINED, That no building or structure of any kind (including but not limited to railroad tracks) may be constructed or erected in or on any part of the street closed under this Ordinance until all subsurface structures and appurtenances owned by the Mayor and City Council of Baltimore have been abandoned by the Mayor and City Council or, at the expense of the person seeking to erect the building or structure, have been removed and relaid in accordance with the specifications and under the direction of the Director of General Services of Baltimore City.
 
  SECTION 5.  AND BE IT FURTHER ORDAINED, That after the closing under this Ordinance,  all subsurface structures and appurtenances owned by any person other than the Mayor and City Council of Baltimore shall be removed by and at the expense of their owners, promptly upon notice to do so from the Director of Public Works.
 
  SECTION 6.  AND BE IT FURTHER ORDAINED, That at all times after the closing under this Ordinance, the Mayor and City Council of Baltimore, acting by or through its authorized representatives, shall have access to the subject property and to all subsurface structures and appurtenances used by the Mayor and City Council, for the purpose of inspecting, maintaining, repairing, altering, relocating, or replacing any of them, without need to obtain permission from or pay compensation to the owner of the property.
 
  SECTION 7.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the date it is enacted.
