Establishing a Uniform List of Towable Parking Violations in Private Parking Lots

 

FOR the purpose of requesting that representatives from the Department of Transportation and the Board of Licenses for Towing Services come before the Council to present guidelines for the practice of Trespass Towing and to begin discussions about what parking violations on private property towing is an appropriate remedy for.

Recitals

  

   WHEREAS, The Board of Licenses for Towing Services has the authority to regulate the conduct of towing companies operating in Baltimore City.

 

   WHEREAS, The Department of Transportation plays a significant role in parking regulation in Baltimore City.

 

   WHEREAS, Currently there is no posted delineation of parking offenses in private lots that the vehicle owner must abide by to prevent a tow.

 

   WHEREAS, Posting agreed-upon parking guidelines would allow both vehicle owners and tow-truck operators to better understand what is prohibited when parking on a private property.

 

   WHEREAS, The Board of Licenses for Towing Services and the Department of Transportation are the City agencies best positioned to create a list of parking violations on private property that towing is an appropriate remedy for.

 

   WHEREAS, If a uniform set of parking violations on private property that towing is an appropriate remedy for can be established, the public and tow-truck operators could be informed of these offenses through posting at private parking lots and clear expectations could be established.

 

   WHEREAS, The City Council, as the elected representatives of Baltimore’s citizens, should be involved in the process of establishing a definitive list of parking violations on private property that towing is an appropriate remedy for.

 

 

   NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF BALTIMORE, that the Council requests that representatives from the Department of Transportation and the Board of Licenses for Towing Services come before it to present guidelines for the practice of Trespass Towing and to begin discussions about what parking violations on private property towing is an appropriate remedy for. 

  

   AND BE IT FURTHER RESOLVED, That a copy of this Resolution be sent to the Mayor, the Director of Transportation, the Chair of the Board of Licenses for Towing Services, and the Mayor’s Legislative Liaison to the City Council.
