Complete Streets - Extended Deadlines; Modified Effective Date

For the purpose of extending various deadlines for the development and adoption of a Community Engagement Plan and a Complete Streets Manual; clarifying certain standards for the Community Engagement Plan; correcting, clarifying, and conforming related language; providing for a modified special effective date for City Code Article 26, Subtitle 40 {“Complete Streets”}, as enacted by Ordinance 18-0197; and providing for a special effective date for this Ordinance.

Sections 3, 4, and 5

 

Section 1.  Be it ordained by the Mayor and City Council of Baltimore, That the Laws of Baltimore City read as follows:

 

                     Ordinance 18-0197

                     {“Complete Streets”}

 

Section 3.  And be it further ordained, That:

 

(1)                     City Code Article 26, Subtitle 40, Part V, as enacted by this Ordinance, takes effect on the date of enactment of this Ordinance {i.e., December 3, 2018}.

 

(2)                     [Within 60 days of the date of enactment of this Ordinance] On or before October 16, 2019, the Transportation Director, in consultation with the Complete Streets Advisory Committee, shall publish and present to the [Land Use and] Transportation Committee a Community Engagement Plan, containing a description of the methods of community engagement to be used to obtain public input.  The [plan] Plan must include methods to overcome barriers to engagement associated with race, income, age, disability, English language proficiency, and vehicle access and include a means of measuring success in overcoming these barriers.  The Plan should demonstrate an earnest application of the recommendations set forth in the attached Letter from Councilmember Ryan Dorsey to then-Transportation Director Mchelle Pourciau (October 19, 2018).

 

[(3) Within 90 days of the date of enactment, the Complete Streets Advisory Committee shall prepare and complete its scoping recommendations for a draft Complete Streets Manual.]

 

(3)                     [(4)] [Within 10 months of the date of enactment] On or before April 1, 2020, the Transportation Director shall, in consultation with the Complete Streets Advisory Committee, propose and publish for public comment a proposed Complete Streets Manual, in accordance with City Code, Article 26, Subtitle 40, Part V, as enacted by this Ordinance.

 

(4)                     [(5)] [The] On or before July 1, 2020, the Transportation Director shall adopt and publish a Complete Streets Manual [within 13 months of the date of enactment of this Ordinance].

 

(5)                     [(6)] From the date of enactment of this Ordinance[,] and until [all parts of this Ordinance are made fully effective] the Transportation Director has adopted and published the Complete Streets Manual, the Chair of the Complete Streets Advisory Committee shall provide to the [Land Use and] Transportation Committee written [monthly] bi-weekly progress reports on development of the Complete Streets Manual and on the status of community engagement related to the implementation of this Ordinance.

 

Section 4.  And be it further ordained, That Section 3 of this Ordinance takes effect on the date of enactment of this Ordinance {i.e., December 3, 2018}.

 

Section 5.  And be it further ordained, That except as provided in Sections 3 and 4 of this Ordinance, this Ordinance takes effect [13 months after the date it is enacted] on the effective date of Ordinance 19-          (Council Bill 19-{Insert # in 1st Reader}) (dlr 19-1092).

 

Section 2.  And be it further ordained, That this Ordinance takes effect on the date it is enacted.
