AN ORDINANCE concerning

Foreclosure Chattels - Notice of Dispossession

 

FOR the purpose of extending, for certain types of foreclosed properties, the period for providing prior notice of the execution of a writ of possession; providing for a special effective date; and providing for the automatic termination of the Ordinance on a certain date.

   SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Laws of Baltimore City read as follows:

 

                     Baltimore City Code

 

                     Article 13.  Housing and Urban Renewal

 

                     Subtitle 8B.  Foreclosure Chattels

 

§ 8B-2.  Notice of pending dispossession.

 

   (b)  How given.

 

(1)                     [The] EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, THE notice shall be:

 

(I)                     [(1)] mailed both by certified mail and by first-class mail with certificate of mailing at least 14 days before the first scheduled date of execution; and

 

(II)                     [(2)] posted on the premises at least 7 days before the first scheduled date of execution.

 

 

(2)                     FOR EVICTIONS THAT FOLLOW A DOCKETED FORECLOSURE AND SALE FOR NONPAYMENT OF A MORTGAGE OR DEED OF TRUST, THE NOTICE SHALL BE:

 

(I)                     MAILED BOTH BY CERTIFIED MAIL AND BY FIRST-CLASS MAIL WITH CERTIFICATE OF MAILING AT LEAST 365 DAYS BEFORE THE FIRST SCHEDULED DATE OF EXECUTION; AND

 

(II)                     POSTED ON THE PREMISES AT LEAST 90 DAYS BEFORE THE FIRST SCHEDULED DATE OF EXECUTION.

 

   SECTION 2.  AND BE IT FURTHER ORDAINED, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.

 

   SECTION 3.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the date it is enacted.  This Ordinance will remain in effect through January 20, 2013, after which date, with no further action by the Mayor and City Council, this Ordinance will be abrogated and of no further effect.
