Request to Board of Estimates - Release of Funds - Contingencies Met
FOR the purpose of requesting the Board of Estimates to release certain embargoed funds withheld from City agencies contingent upon performance (CUP) of a satisfactory level of service because the agencies are now in compliance with prerequisites set by the City Council.

Recitals
On June 16, 2008, the Council adopted CC08-0055R - Fiscal Year 2009 Budget - Release of Funds to City Agencies - Contingent Upon Performance (CUP) - that authorized the Board of Estimates to release funds that had been withheld from certain agencies pending their demonstration of compliance with prerequisites set by the City Council.
Agencies from which funds were withheld included: the Mayor's Office of Cable and Communications, Program 572; Department of Finance, Program 142; Department of Housing and Community Development, Program 357 and Program 260; Baltimore Development Corporation, Program 585; Department of Transportation, Program 500; and the Mayor's Office of Criminal Justice, Program 583.
As stated in the Resolution, CUPs are an instrument to ensure a satisfactory level of service by City agencies and are not a punitive measure. Upon satisfactory performance and satisfaction of City Council CUP contingencies, the City Council will request release of the embargoed funds.
Passage of this Resolution constitutes the City Council's statement of satisfaction with the subject agencies performance of CUP requirements and the request to the Board of Estimates to release the funds.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF BALTIMORE, That the Board of Estimates is hereby formally requested to release certain embargoed funds withheld from City agencies contingent upon performance (CUP) of a satisfactory level of service because the agencies are now in compliance with prerequisites set by the City Council.

AND BE IT FURTHER RESOLVED, That a copy of this Resolution be sent to the Mayor, the Honorable Members of the Board of Estimates, the Director of Finance, the Director of the Mayor's Office of Cable and Communications, the Commissioner of Housing and Community Development, the President of the Baltimore Development Corporation, the Director of Transportation, the Director of the Mayor's Office of Criminal Justice, and the Mayor's Legislative Liaison to the City Council.
