  SECTION 1.  BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Laws of Baltimore City read as follows:
 
      Baltimore City Code
 
      Article 15.  Licensing and Regulation
 
      Subtitle 17.  Street Vendors
 
§ 1715.  TERM; RENEWAL; Fees.
 
  (A)  TERM.
 
UNLESS RENEWED, A LICENSE EXPIRES ANNUALLY ON JUNE 30.
 
  (B)  RENEWAL.
 
(1)      TO RENEW A LICENSE, THE LICENSEE MUST APPLY NO LESS THAN 30 DAYS NOR MORE THAN 60 DAYS BEFORE THE LICENSE  EXPIRES.
 
(2)      THE RENEWAL APPLICATION MUST:
 
 
 
(I)      BE IN THE FORM AND CONTAIN THE INFORMATION THAT THE BOARD REQUIRES; AND
 
(II)      BE VERIFIED IN THE SAME MANNER AS REQUIRED FOR AN INITIAL APPLICATION.  
 
(3)      THE BOARD MUST REFUSE TO RENEW A LICENSE IF:
 
(I)      THE LICENSE WAS ISSUED FOR A SPECIFIED LOCATION OR AREA; AND
 
(II)      AFTER NOTICE TO THE LICENSEE AND AN OPPORTUNITY FOR THE LICENSEE TO BE HEARD, THE BOARD FINDS THAT, DURING THE THEN-CURRENT LICENSE YEAR, THE LOCATION OR AREA WAS UNUSED BY THE LICENSEE FOR 25% OR MORE OF THE TIME AUTHORIZED, AS DEFINED BY THE BOARD IN ITS RULES AND REGULATIONS.
 
  (C) [(a)]  FEES - In general.
 
     (1)  Food products.
 
        The annual fees for a license to sell food products are as follows:
 
(i)      In the downtown area - $375.
 
(ii)      Outside the downtown area:
 
                 (A) Sales from a vehicle - $75.
 
                 (B) Sales from a basket, handcart, or pushcart - $25.
 
     (2)  Other merchandise.
 
The annual fee for a license to sell merchandise other than food products is $75.
 
  (d) [(b)] FEES - Proration.
 
If the license is issued after June 30 of any calendar year, the initial license fee is ½ the annual fee.
 
§ 1731.  Revocations, [and] suspensions, AND REFUSALS TO RENEW.
 
  (a)  Authorized suspension, [or] revocation, OR DENIAL.
 
The Board may suspend, [or] revoke, OR REFUSE TO RENEW a license if the licensee violates any provision of:
 
(1)      this subtitle;
 
(2)      the rules and regulations adopted under this subtitle; or
 
(3)      any other applicable law of the State or City.
 
 
§ 1732.  Administrative appeals.
 
(a)  Right of appeal.
 
An aggrieved party may appeal to the Board of Municipal and Zoning Appeals:
 
(1) the denial, suspension, or revocation of OR REFUSAL TO RENEW a license; or
 
         (2) any other decision or ruling by the Board of Licenses.
 
  SECTION 2.  AND BE IT FURTHER ORDAINED, That the catchlines contained in this Ordinance are not law and may not be considered to have been enacted as a part of this or any prior Ordinance.
 
  SECTION 3.  AND BE IT FURTHER ORDAINED, That this Ordinance takes effect on the 30th day after the date it is enacted.
