FOR the purpose of requiring the address number of a building to be affixed or otherwise placed, in a certain manner, at the rear of the building as well as at the front; increasing the penalty for a violation of the laws governing building addresses; providing for alternative enforcement by environmental citation; conforming, correcting, and clarifying related language; providing for a special effective date; and generally relating to the numbering of houses and other buildings in the City of Baltimore.

SECTION 1. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF BALTIMORE, That the Laws of Baltimore City read as follows:

Article 26. Surveys, Streets, and Highways
Subtitle 6. [House] BUILDING ADDRESS Numbers
§ 63. Duty to affix numbers.
(a) Affixing to new buildings.
The owner of any new house or other building shall affix or place on the premises, in the manner prescribed in this subtitle, the correct number of [said] THAT house or other building, as determined and fixed by the Department of Public Works [when the said house or other building has been substantially completed].
(b) Maintaining on all.
The owner or occupant of any house or other building shall affix and shall at all times [keep affixed] MAINTAIN on the premises the correct number of [said] THAT house or [any] other building, as determined and fixed by the Department of Public Works.
§ 67. [Arabic numerals; visibility] REQUIRED DISPLAY.
The correct number of every house or other building:
(1) shall be displayed in Arabic numerals;
(2) shall consist of a number plate or other means of numbering satisfactory to the Director of Public Works; and
(3) shall be affixed or otherwise placed:
(I) at the front entrance of [said] THE house or other building or the front entrance to the premises on which [any such] THE house or other building is [erected] LOCATED so [as to be] THAT THE NUMBER IS plainly visible and legible in daytime from a point LOCATED 4 feet above the curb line [and located] immediately in front of the [said front] entrance ON WHICH THE NUMBER IS PLACED [of any such house or other building or the said front entrance to the premises on which any such house or other building is erected]; AND
(II) AT THE REAR OF THE HOUSE OR OTHER BUILDING SO THAT THE NUMBER IS PLAINLY VISIBLE AND LEGIBLE IN DAYTIME FROM A POINT LOCATED 4 FEET ABOVE THE GRADE LEVEL OF THE ALLEY OR OTHER PROPERTY IMMEDIATELY BEHIND THE STRUCTURE ON WHICH THE NUMBER IS PLACED.
§ 69. ENFORCEMENT BY CITATION.
(A) IN GENERAL.
IN ADDITION TO ANY OTHER CIVIL OR CRIMINAL REMEDY OR ENFORCEMENT PROCEDURE, THIS SUBTITLE MAY BE ENFORCED BY ISSUANCE OF AN ENVIRONMENTAL CITATION AS AUTHORIZED BY CITY CODE ARTICLE 1, SUBTITLE 40 {"ENVIRONMENTAL CONTROL BOARD"}.
(B) PROCESS NOT EXCLUSIVE.
THE ISSUANCE OF AN ENVIRONMENTAL CITATION TO ENFORCE THIS SUBTITLE DOES NOT PRECLUDE PURSUING ANY OTHER CIVIL OR CRIMINAL REMEDY OR ENFORCEMENT ACTION AUTHORIZED BY LAW.
§ 610. [§ 69.] Penalties.
(A) IN GENERAL.
Any [owner or occupant failing to comply with or violating] PERSON WHO VIOLATES any [of the provisions] PROVISION of this subtitle [shall be] IS GUILTY OF A MISDEMEANOR AND, ON CONVICTION, subject to a fine of not more than [$10] $500 for each offense [and to an additional fine of $10 for every day that such noncompliance or violation shall continue].
(B) EACH DAY A SEPARATE OFFENSE.
EACH DAY THAT A VIOLATION CONTINUES IS A SEPARATE OFFENSE.

SECTION 3. AND BE IT FURTHER ORDAINED, That this Ordinance takes effect 120 days after it is enacted.
