Recitals

Senate Bill 231, the Maryland Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act (the Act), addresses the issue of jurisdiction over adult guardianships, conservatorships, and other protective proceedings. The Act seeks to clarify jurisdiction and to provide a process for addressing dilemmas where more than one state is involved.

The ULC Quarterly Report, a March 2008 publication of the Uniform Law Commission, reported in response to the fact that there are more than 50 guardianship systems in the United States that the Act provides an effective mechanism for resolving multi-state jurisdictional disputes by providing specific guidelines to specify which court has jurisdiction to appoint a guardian or conservator for an incapacitated adult.
